At around 23K mine started to 'play up', looking on the forums, and I found this was a 'known issue'. Further reading and depending on where in the world you are it may or may not have been a recall or just a warranty replacement, but there was a TSB (Technical Service Bulletin) issued by BMW, and here in the UK they replaced the early switchgear with the newer version under a 'product enhancement' or at least they did.

Now mine has started to fail - just the cruise control at the moment not working. So far the dealer has charged me 1.5 hours of labour to tell me what I already knew - the switchgear is faulty. While they have admitted that they 'used to replace both switches' that is no longer the case, and they say on checking the BMW system, nothing shows up for my bike as outstanding. Hence, I'm facing the bill for parts and labour for both if I want both done or just the one if I only get the currently faulty one done.

So, the question is just how long does it take after a 'TSB' and warranty replacement, and such like stay on the books before, it is just down to the owner?

Just because a bike has low milage, hence the issue doesn't show up, should there be a time limit on the replacement if they have previously not been replaced?

I don’t know the legal answer. And ethically, it’s not clear to me. It’s a 12 year old motorcycle. Things wear out. Even if it’s a known issue, it may or may not have been an affected part. I would ask if the dealer coul split it with me, or discount the part if they’re not getting reimbursed from the manufacturer for the labor. It’s a bummer. But the money we save buying used is often spent on upkeep etc. I’m sorry you’re faced with this expense. Many buyers of older bikes ask the forum about what to look for prior to purchasing. One of the common answers is the switch gear replacement. I do wish you well in resolving it.

Call your local dealer with the last 7 digits of your VIN and they can tell if your bike has an open recalls.

I can’t give a definitive answer to that, but I’d be very surprised if it was more than 10 years from initial registration, unless it was a safety recall in which case I believe there is no time limit.

I’d guess that your best option is to ask the dealer to apply to BMW UK for a goodwill contribution?
